(1) If the foreign bidder has appointed his agent in Nepal while submitting the bid, he should mention the following details regarding such agent:--
(a) Name and address of agent,
(b) the amount of commission to be received by the agent, the currency and method of payment,
(c) any other terms with the Agent,
(d) If he is a local agent, a certified copy of his permanent account number registration certificate and a letter accepting him to be an agent.
(2) When the agent submits the bid on behalf of the foreign bidder, the matters mentioned in clauses (b) and (c) of sub-rule (1) should be clearly mentioned.
(3) If the foreign bidder does not clearly disclose the matters mentioned in sub-rule (1) or if it is later proved to be an agent for submitting the bid as not being a local agent, or if it is proved that the agent took more commission because the commission given to the agent is less, then such bidder shall be blacklisted by the public body in accordance with rule 141 Action should be taken to keep it.
